I'm writing this paper to address two specific Supreme Court Decisions that have had a major impact on an individual's Constitutional Rights. The Bill of Rights, which protects all citizens from government infringement, was violated in these two cases but rectified by Supreme Court action. The two cases that I will address are Powell v. Alabama, which occurred in 1 in Alabama, and Gideon v. Wainwright, which occurred in Florida in 16.


In Powell v. Alabama nine black youths were arrested and charged with the rape of two white girls. The offense is said to have been committed on a freight train traveling through Alabama. A fight took place between the nine black youths and seven white boys and two white girls. The white boys were thrown off the train and a message was sent ahead reporting the fight. A sheriff's posse met the train in Scottboro, Alabama and the posse seized the black youths. The record, of the case, indicates that all of the black youths were ignorant and illiterate and all of them were residents of other states. The "boys" (as they were referred to) were kept under military protection because of the hostility in the community. Immediately after the indictment the "boys" were arraigned and plead not guilty, they were not asked whether they were able to employ counsel, or wished to have counsel appointed or whether they had friends or relatives who could assist.


Powell v. Alabama was the first of the ensuing rape trials. Powell's argument addressed the lack of legal representation that he was given. The day of the trial, the attorney appointed to his case refused to represent him; the judge ordered any attorney present in the court room to serve as the boy's legal counsel and they all refused. Once counsel willing to represent him was found, the attorney had no time to review the case and only half an hour to meet with his client before the hearing. Because of the inadequate defense, Powell was sentenced to die along with his eight friends.


The issue before The Supreme Court was the due process clause of the Fourteenth Amendment incorporates the right to counsel in a capital case? The Supreme Court voted yes (7-) and reversed the verdict because of its belief that poor people facing the death penalty must be provided with counsel, stating "…there is a certain principal of Justice which adhere to the very idea of free government, which no [State] may disregard." Justices Butler and McReynolds dissented on the facts that the record failed to reveal that the petitioners had been deprived of any rights guaranteed by the Federal Constitution and thought the judgement should be affirmed.

This is symbolic of Daisy's life She is kept in the closet until it's time to show off for company, then she becomes alive and personable. She views herself as sophisticated and smart, while really she is the opposite! Daisy says, I know. I've been everywhere and seen everything and done everything…Sophisticated God, I'm sophisticated (Fitzgerald, 8)!"


Daisy's arrogance is shown in this quote. She seems to be so smart, but at the same time does not know her husband is having an affair with another woman. Daisy married her husband, Tom, solely for his money and social status.


The women in both novels are also portrayed as extremely foolish and easily used by men. Myrtle and Daisy are both excellent examples. Daisy is foolish because she does not know about Tom's affair with Myrtle, and Tom is degrading Myrtle by his selfish actions. Both Daisy and Myrtle rely solely on money and fame. Daisy always tries to be the center of attention and Myrtle is obsessed with money. Daisy blurts out that she thinks a girl should be foolish when she talks about her daughter, "I'm glad it's a girl. And I hope she'll be a fool-that's the best thing a girl can be in this world, a beautiful little fool (Fitzgerald, 50)". Daisy uses her daughter as a play toy. Hello, I am so sorry to have been so long in writing. I had every intention of getting around to it, but didn't. We had our house under contract early June but still had not even found a place to live by early July. Talk about stressed out! We were to close on the old house on August 1st with the hope of finding something within that time frame. Well, fortunately we found something the first week in July and fortunately the people were willing to close August 1st. We also needed to be quick about things because school started August 1th. The week before closing we had to get a Termite Letter. That was causing some trouble, about $00.00 worth! Closing on both homes turned out fine! We now live in Gem Lakes. It is a two-story brick home with a beautiful and tranquil yard. Everything is just about unpacked and the kids are adjusting to their new school. The school bus actually picks them up and drops them off right in front of the house. We never had that luxury in Riverbluff! Anyway, I'm starting to relax more now.


I sure hope the summer has been good to you. It went by fast and we didn't even get to enjoy it.

Trials and tribulations that when we slumber should be washed away with our dreams. In our dream state we are given another world to live in. Another world where we can influence the outcome of these same trials and tribulations we are faced with to make them triumphs in the world we wake up to.


In this reality we can now become true to the image we were created from so as not to be held in contempt of the lives we choose to live.

He works really hard and saves every penny he makes. It takes him two years of working and saving and he finally has the fifty dollars that he needs. Billy tells his Grandpa about his savings. Grandpa is very proud of him. He promises to order the dogs for him. He gives him a big helping of candy from his store. Billy takes the candy home and shares it with his three sisters.


After two weeks, Grandpa tells Billy that his dogs are in but they are miles away in the town of Talhquah. It will take two more weeks for the dogs to get to him. Billy can't wait. He sneaks off in the middle of the night to go to town and pick up his dogs. He walks all the way. When he gets to the Post Office, he picks up his pups and can't believe that they belong to him. He puts them in his gunny sack and starts to go into town. The pups cost $45.00, saving Billy $5.00. He decides to spend the money on gifts for his family.


When Billy is in town, he sees a lot of children playing in a playground. There is a big building near the playground. It is a school. It's the first time Billy has ever seen a school. The kids look at this "hillbilly" and start pointing and laughing at him. Billy feels very bad. A bell rings and all the kids go into the school. Billy plays in the playground for a while. Then he goes into a store and buys gifts for his family. He starts his journey home, and some kids start pulling on his gunny sack, and the pups are very scared. He already loves his pups and no one is going to hurt them. He starts defending his pups and the kids beat him up. A Marshall shows up, breaks up the fight and gives Billy his first soda pop to cheer him up.
